TERMS & CONDITIONS
We take pride in precision, but the final examination for accuracy is the Customer's responsibility. Before giving approval, please examine all proofs carefully for the accuracy of information presented, including spelling, punctuation, numbers, graphics, colors, sizes and general layout. However, if we should make an error in producing the work as proofed, please be assured that we will redo the work as quickly as possible and without charge to you.
Sizing & Measurements: Measurements given to Sphere Graphics Co., from the Customer are deemed to be accurate and all art will be sized accordingly. Proofs will include all sizes given to the Vendor from the Customer. Any variance (+/-) will be the responsibility of the customer in the case of re-prints or repairs.
Vendor’s Liability: Vendor’s total liability is hereby expressly limited to the services indicated on the invoice and Vendor will not be liable for any subsequent damages, consequential damages, or otherwise. All dates promised on this invoice are approximations unless the word “firm” is written and acknowledged by the Vendor. We are not responsible for damage on vehicles surfaces and other, with paint problems or repainted surfaces without a correct treatment; we use appropriate materials for each work with manufacturer's specifications. We are not responsible for any objects left in vehicles.
Payment: Our normal production cycle will not begin until we receive written approval of your estimate and proof, as well as the required 50% payment deposit. The standard proofing process is composed of an initial layout and two revisions maximum. This initial design is property of Sphere Graphics Co., and cannot be reproduced without our authorization.
Any revisions beyond that are subject to a $20 fee per revision or $75 per hour in design time. We cannot accept changes or approvals verbally.
Collection Procedures: Invoices are considered delinquent thirty (30) days from the date that your order is completed. After the thirtieth day, a late charge of $25.00, together with interest accruing at the rate of 1.5% per annum, or the maximum rate allowable by law is assessed. The customer shall be liable for all costs related to collection of delinquent invoices, including court costs and attorney’s fees.
Customer Design Approval: Customer shall approve either personal or through his/her agent(s) and/or employee(s) by written proof, the final design prior to the work to commence. This approval constitutes acceptance of full responsibility for all errors, omissions and legal and ethical compliance in the document. Sphere Graphics Co. will not accept liability for errors overlooked at this stage of proofing. Any changes from the previously approved document will be charged extra according to both time and material.
Customer Acceptance of Work: Customer’s acceptance, either personal or through his/her agent(s) and/or employee(s) of the work ordered shall be deemed as full acceptance. This means that by accepting delivery of the work, customer affirms that the work substantially conforms to all expectations
Loss of Substantially Forgotten Work: If customer does not take possession of the completed work within thirty (30) days from notification of completion, then the work will be considered lost or forgotten. Vendor will not be responsible for further loss. Customer will be billed and is responsible for payment for work that has been completed.
Privacy Statement: We will not share or sell any information that has been gathered during order processing with anyone. We use our customer information in house, for the sole purpose of order fulfillment.
Right to use Artwork/Products: We and our affiliates have an unrestricted license to use, display, reproduce, modify, transmit and distribute information and designs given to us by you to the extent permitted by law. We reserve the right to use photos of your artwork/products as samples of our work we have completed for use in advertising media including, but not limited to, our brochures, signage, website, etc. We will not sell images or information given to us by you unless prior written consent has been given. We also reserve the right to use your printed products for samples or promotional advertising purposes.
Warranty: Unless otherwise stated, all work have 1 (one) year warranty from the date of job completion. By agreeing to a job and placing the corresponding deposit, the Customer authorizes Sphere Graphics CO. to perform any adjustments or repairs to the ongoing work at anytime without prior notification before the job is finalized, after which the warranty period starts and any adjustments or repair needed after will be notified to the Customer before proceeding.
Online Shop: Do to the custom nature of each order all sales are FINAL we DO NOT Issue refunds of any kind. If you have a color issue, we will be happy to exchange any item for another color of the same or to a different item of the same value if you pay the exchange fee to cover shipping charges. All returned items must be sent in the same condition they are delivered in (IE 100% Resale Condition) to be exchanged. If you received a damaged item we will replace it after Photo Proof is sent to the alex@spheregraphicsco.com with your name, item purchased and date of purchase info. We Are not responsible for Installation errors or miss installation of any item. Installation is the sole responsibility of the purchaser and is done at his or her own risk. We will be happy to sell you additional items to fix any mistakes that may happen. Some Examples of Mistakes are: to much soap in the water causing item not to stick properly, Creasing an item or getting an items backing paper wet causing it to stick to the paper are just some examples of things not covered. By purchasing and paying for this item the buyer agrees to these terms and conditions.
